How is an Affidavit of Heirship Different Than Probate? An Affidavit of Heirship is not a formal adjudication like probate is. Rather, it is an affidavit outlining the deceased persons family history and the identity of heirs. Nothing is filed in the Probate Court.
In Texas, an affidavit of heirship is typically not required if the person is the sole heir to the estate. However, if there are other heirs, an affidavit of heirship may be required in order to transfer ownership of the estate to the person named on the document.
How is an Affidavit of Heirship Different Than Probate? An Affidavit of Heirship is not a formal adjudication like probate is. Rather, it is an affidavit outlining the deceased persons family history and the identity of heirs. Nothing is filed in the Probate Court.
This document can be used to probate an estate and transfer ownership of the estate to the person who is listed as the heir in the document. An affidavit of heirship must be certified by a notary public or other official authorized to docHub documents. The notary public will usually charge a fee for this service.
No probate will be necessary to transfer the property, although of course it will take some paperwork to show that title to the property is held solely by the surviving owner. In Texas, two forms of joint ownership have the right of survivorship: Joint tenancy.
An affidavit of heirship can be used when someone dies without a will, and the estate consists mostly of real property titled in the deceaseds name. It is an affidavit used to identify the heirs to real property when the deceased died without a will (that is, intestate).
While an Affidavit of Heirship can be an appropriate alternative for some, a probate proceeding is a safer alternative to establish a link in the chain of title when dealing with real property. Please contact us to discuss your situation.
The legal effect of the affidavit of heirship is that it creates a clean chain of title transfer to the decedents heirs. An affidavit of heirship should be signed by two disinterested witnesses.
