Frequent job hopping means that knowledge and skills are mobile too and that makes companies feel pressure to limit your post-employment options. At best, they do this to protect company knowledge from finding its way to competitors. But at worst, these agreements are used to scare employees and may even have an impact on innovation across the entire economy. Typical non-compete periods are six months to one year, but they can last longer. However, it is difficult for businesses to enforce long-term non-compete agreements legally. Some states will not enforce these agreements, and a few do not recognize them as legal.

If you decide to ignore the non-compete agreement, your former employer may sue you. Typically, the only way to fight a non-compete agreement is to go to court. If you are an employee (or former employee) who signed such an agreement, this means you must violate the agreement and wait to be sued.
Most non-compete contracts prohibit competitive activity by the ex-employee within a certain number of miles of the employers business. The typical language prohibits competitive activity within a 15 to 25 mile radius of the employers business.
Another common reason that courts refuse to enforce a Non-Compete is that the agreement restricts the employee from competing for an unreasonably long amount of time. For example, a court will likely refuse to enforce an agreement that prohibits an employee from competing for the rest of his or her life.
Typically, the only way to fight a non-compete agreement is to go to court. If you are an employee (or former employee) who signed such an agreement, this means you must violate the agreement and wait to be sued. It may be that your former employer has never sued another employee to enforce the non-compete agreement.
A Non-Compete Agreement typically lasts six months to two years, but varies depending on your states laws. A judge is likely to find anything longer than that to be unreasonable, and an indefinite agreement is out of the question.
