[Music] hello my name is Naomi Wilson and I provide legal advice to landlords and tenants here at a Cepeda sen today were going to discuss some of the common misconceptions that landlord clients have about whether or not their tenants have a right to stay in the property at the end of a commercial business lease the landlord and tenant act 1954 protects all commercial business tenants so that at the end of their lease term they have a statutory right to require their landlord to grant them a new lease in similar terms to the existing lease you would need to discuss the issue with your tenant before the lease is signed and make sure they understand that theyre going to contract out of those security of tenure provisions afforded by the 1954 Landlord and Tenant act they will need to sign a declaration which confirms that before they completed their lease with you as the landlord they were served a notice explaining to them that they were going to have to contract out of their security

Contents of a termination of lease letter Your name and the landlords name and address. The date youre writing the letter. Informing the landlord youre breaking your lease early. The reason why youre breaking your lease. The building and apartment youre vacating. The date by which youre vacating.
Are texts considered written notice? If you want texts to be legally binding between both parties, that agreement must be set up beforehand and must be in writing.
Ask for more time to move. If you lose your eviction case, you need to move out (at the latest) 5 days after the sheriff posts a Notice to Vacate on your door. If you need more time to move, you can ask the court for a stay of execution. You will need to show the court that you have a good reason for needing more time.
Time for Service The Sheriff will serve a 5-Day Notice to Vacate within three business days after receipt of the writ. The eviction occurs as soon as possible after the expiration of the 5-day notice. The writ of execution (possession of real property) expires 180 days after its issuance date.
You can: pay the full amount of rent that is overdue, move out voluntarily, make a rent payment plan or moving plan in agreement with the landlord, temporarily stop the eviction by filing for bankruptcy, wait for the sheriffs deputy to show up to your doorstep, or try to fight the eviction in court.
After Sheriff Lockout California You have to have a locksmith there to get the sheriff access. The sheriff goes into the property, looks around to make sure there is nobody hiding under the bed, and will escort out anybody that is present and turn possession over to the owner.
Get an order from the court to keep the landlord from locking you out again. You will need legal help for this from a lawyer. Under California Civil Code 789.3, you can sue your landlord for punitive damages, plus attorney fees for each day you are locked out of your apartment.
After the Writ of Execution has been served to the tenants, they will be given a grace period of 5 days to vacate the property. The sheriff will execute the eviction and forcibly remove them if they remain in the property after the grace period given to them.
