A survivorship clause states that beneficiaries named in the document cannot inherit unless they live for a specific amount of time after the will- or trust-maker dies. This time is called a survivorship period, and commonly ranges from about five to 60 days.
Without a survivorship clause, then any gifts of the estate on first death would need to pass to the survivor before it can be distributed to any further beneficiaries. This will mean the assets of the first testator will be calculated for IHT on first death and again on second death.
The simple answer is yes, as the use of a survivorship clause can be beneficial in certain cases enabling the estate to save a lot of money, usually from inheritance tax (IHT).
A survivorship clause is exactly what it sounds like; a clause in a will that makes a gift to a beneficiary conditional upon them surviving the testator by a set period of time.
These clauses aim to avoid situations where your assets would pass under your beneficiarys estate plan, not yours, when the beneficiary only outlives you by a short time.
Under a survivorship clause, the beneficiary only inherits if he survives for the stated period after the testators death. Failure to survive the requisite period causes the gift to pass as provided in the will. A common survivorship period, often adopted, is 28 days but may be as long as desired.
A survivorship requirement means that a beneficiary cannot inherit from you unless he or she lives for a certain period of time longer than you do. In general, its a good idea to include a survivorship clause in your will or trust.
A major issue with survivorship destinations is that once the clause is included, it cannot be revoked by one party; both parties must agree to remove it by having another deed prepared. The clause does not allow for any flexibility and will always trump the wishes of the deceaseds Will.
