A loan must meet several standards to be considered a qualified mortgage under the ATR/QM rule. First, it must avoid risky loan features, such as negative amortization, a term longer than 30 years, a balloon or interest-only payments, or fees that typically exceed 3% of the full loan amount.
HMDA requires financial institutions, including credit unions, to compile and disclose data about home purchase loans, home improvement loans, and refinancings that they originate or purchase, or for which they receive applications.
If the loan or line of credit is neither a closed-end mortgage loan nor an open-end line of credit, the transaction does not involve a covered loan, and the financial institution is not required to report information related to the transaction.
A preapproval request that is closed for incompleteness is not reportable under HMDA. See 1003.4(a) and comment 4(a)-1. ii.
Although banks typically like to loan to applicants with domestic income, its not impossible for you to get a mortgage with foreign income. As long as you report the income correctly and it meets the banks requirements, you can obtain a mortgage, regardless of where your income originates.
Which type of loan transaction is NOT covered under the HMDA reporting requirements? Neither unsecured home improvement loans nor loans on unimproved land are covered transactions.
Modification to Mortgage or Deed of Trust A modification to the collateral document, the mortgage or deed of trust, has no impact on HMDA reporting. If there is a new note, and the mortgage or deed of trust is modified, the note is reportable if not otherwise excluded.
Lien Status The bank should not report unsecured home purchase loans under HMDA because such loans are not secured by a dwelling. The definition of home purchase loan in 203.2(h) is a loan secured by and made for the purpose of purchasing a dwelling.
