- Well hey there, this is Seth and in this video Im going to take you through the process of how to put together a warranty deed and a quick claim deed. If you know anything about deeds, those two types of deeds are actually very very different from each other but in terms of the actual information that has to go into the document, its fairly similar across both of them. Creating a deed is actually a fairly simple thing just in terms of what information you have to put in there and how to put it all together so if thats something youre trying to do, I just want to show you the basics of how that is done and Im gonna be showing you on a couple of blank templates that Ive used in the past and I will say that these deed templates Im going to be showing you do not work in all 50 states so dont just take these and start using them whenever you want to. In Texas, a quitclaim deed conveys only the grantors rights, if any, in the real property. A quitclaim deed contains no warranties of any kind and does not establish title in the person holding the deed.

Section 13.001 - Validity of Unrecorded Instrument (a) A conveyance of real property or an interest in real property or a mortgage or deed of trust is void as to a creditor or to a subsequent purchaser for a valuable consideration without notice unless the instrument has been acknowledged, sworn to, or proved and filed
Section 5.008 of the Texas Property Code requires the disclosure notice be provided to a buyer on or before the effective date of the contract.
Notwithstanding the foregoing, if a quitclaim has been recorded for four or more years, Property Code Section 13.006 allows a subsequent purchaser to attain bona fide purchaser status free of any constructive notice of title defects such as unrecorded conveyances or encumbrances.
The first way to cancel a quitclaim deed is to draft, sign, and record a new deed transferring the property back to the grantor. As quitclaim deeds are generally used in property transfers involving family members or persons who trust each other, both parties may consent to use a new deed to reverse the document.
Both the seller (called the grantor) and the buyer (called the grantee) are obligated to uphold the terms of the transfer. Once the transfer is complete, there is no way to nullify or undo a quitclaim deed unless both parties consent to the arrangement.
A lawful quitclaim deed includes the names and addresses of each grantor and grantee, and a complete legal description of the property (59.310, RSMo). Include the preparers name, address, and signature as well. Besides these requirements, the form must meet all state and local standards for recorded documents.
