signing a quick claim deed to release your rights of ownership in a piece of real estate does not absolve you of your responsibilities to pay the mortgage if you have one i just had a friend of mine who just went through a divorce and he said that the judge said his wife gets to stay in the house so he thought he was doing the smart thing by signing over a quitclaim deed to her and he thought because he did that he was free of having to pay the mortgage i tried to tell him and i felt bad for him thats not what you did you cannot release yourself from the mortgage with a click quit claim deed the only way to do that is to either have his spouse refinance the house into her name or assume the mortgage through the proper channels so bad news for him he is going to be on the hook for that mortgage until one of those two things are done or until it gets foreclosed on you
