Below are some common questions from our customers that may provide you with the answer you're looking for. If you can't find an answer to your question, please don't hesitate to reach out to us.

If you wish to remove someone from a deed, you will need their consent. This can be done by recording a new deed, which will require their signature. If the person in question is deceased, you will need their death certificate and a docHubd affidavit along with the new deed.
The deceased co-owner simply drops off title and the surviving co-owner(s) remain on title. For real estate in Ontario, this change in ownership is registered by registering a deed of transmission, which requires little more than an original or docHubd copy of the death certificate.
The grant of probate (or letters of administration) also needs to be sent to the Land Registry, because this tells them who has authority to transfer the property. The general term for this document is a grant of representation. The same applies if the property is going to be sold.
To remove an owner from title upon death requires application to the court to have the will proved and appointment of an executor. If you are unsure, do a title search to confirm what your tenancy is on title.
You need to apply to the court for a grant of probate. Once you have your grant of probate, you need to make an application to the Land Registry to change the register using form AP1. This needs to be accompanied by a sealed or certified copy of the grant of probate and a document called an assent (form AS1).
In order to remove the name of the deceased, Form DJP (Deceased Joint Proprietor) must be completed and filed along with a copy of the death certificate. There is no requirement to show the Grant of Representation to the Land Registry, which means updating the title deed can be done soon after death.
Create a Survivorship Affidavit to Remove a Deceased Owner A survivorship affidavit (sometimes called an affidavit of death or affidavit of continuous marriage) is a legal document used to remove a deceased owner from title to property by recording evidence of the deceased owners death in the land records.
Whilst you dont necessarily need a solicitor to transfer ownership of a property after death, once the new title deeds of the property have been issued by Land Registry, you will need a notary a qualified lawyer specialising in property law or probate as they will need to docHub the new deeds.
