In order to qualify for military leave from work, the employee must offer advanced notice, written or verbal, of the upcoming military service or training. Additionally, the employees cumulative military leave cannot exceed five years, and he or she must be discharged honorably from military service.
Military Leave is any time off that is provided to staff who are members of the National Guard or other reserve component of the United States Armed Services and who are called to active duty, attend scheduled reserve service, and/or temporary training duty.
You may be granted emergency leave if there is a family emergency involving a member of your household, immediate family, or a sole surviving relative whenever circumstances warrant and the military situation permits. The emergency must be verified and approved by the commander.
If you have completed your training and served over 6 months, you will be entitled to terminal leave. You will get one day for each completed month of reckonable service up to a maximum of 20 days. Terminal leave is the same as any other leave but you are free to take up paid civilian employment during this time.
1 indicates that unit commanders have the responsibility to approve or deny emergency leave on a case-by-case basis based on their knowledge of the circumstances. However, this apparent discretion must be considered in light of paragraph 4.1.
The use of paid time off/vacation benefits is the employees choice for military-related absences. An employer is prohibited from requiring employees to use their leave benefits for a military absence; however, the employer must allow the use of paid leave if an employee requests it. See 20 C.F.R.
Commanders are required to send a DA Form 4187 to finance for field meal deductions from the soldiers pay accounts. meals as they consume them at a discounted daily rate. Soldiers receiving separate rations (SR) or rations not available (RNA) retain their SR or RNA if drawing prior to the TDY.
Regular military leave is any paid leave taken for personal reasons, including vacations, family care, errands or any other purpose. Regular leave is used on workdays and also any time the service member is leaving the vicinity of their duty station, as defined by their command, on a weekend or holiday.
