The trust is an independent legal entity once it has been created and it operates that way. As a result, the founder of an irrevocable trust does not have the independent authority to dissolve it. Instead, in most cases, an irrevocable trust can only be dissolved by court order.
The downside to irrevocable trusts is that you cant change them. And you cant act as your own trustee either. Once the trust is set up and the assets are transferred, you no longer have control over them, which can be a huge danger if you arent confident about the reason youre setting up the trust to begin with.
With an irrevocable trust, the transfer of assets is permanent. So once the trust is created and assets are transferred, they generally cant be taken out again. You can still act as the trustee but youd be limited to withdrawing money only on an as-needed basis to cover necessary expenses.
Trustees generally do not have the power to change the beneficiary of a trust. The right to add and remove beneficiaries is a power reserved for the grantor of the trust; when the grantor dies, their trust will usually become irrevocable. In other words, their trust will not be able to be modified in any way.
What if a beneficiary refuses to provide social security number for form K-1. Yes, the trust needs to file its final return and the K1 needs to be distributed. The assets have been disbursed already.
As the Trustor of a trust, once your trust has become irrevocable, you cannot transfer assets into and out of your trust as you wish. Instead, you will need the permission of each of the beneficiaries in the trust to transfer an asset out of the trust.
You can generally modify the trust, with the written consent of the settlor and beneficiaries, even if it is irrevocable. California law says that you can do this on your own, without court approval. However, it is still best to take the matter to a probate court and have the change formally approved.
As such, there is no legal way to stop paying Social Security taxes without applying and receiving approval or becoming a member of a group that is already exempt.
