The request for addition or removal of applicant should be accompanied with original assignment, agreement, an official copy or docHubd copy for inspection by the Controller. The Controller may, request further proof of title or written consent.
Assignments made for value, or with consideration, are irrevocable. This means that the assignor cannot cancel or take back the assignment.
The Act does not have dedicated provisions for removing inventors who were named while filing the patent application. However, relying on sections relevant to inventorship, a petition requesting the Controller to remove an inventor who was named at the time of filing the patent application can be filed.
You should know that it is not legal for someone who did not invent anything to learn about your invention from you and then race to file before you file your patent application. This is because only an inventor can file for patent protection, and if someone steals the idea from you, they are not the inventor.
Inventorship of a patent is central to the United States patent system. It identifies who conceived the invention and, if incorrect, jeopardizes the validity of the patent.

In requesting the Office to effectuate a court order correcting inventorship in a patent pursuant to 35 U.S.C. 256, a copy of the court order and a certificate of correction under 37 CFR 1.323 must be submitted to the Certificates of Correction Branch. In addition, form PTO/SB/44 should be filed.
If inventors have been improperly added or omitted, the patent must be corrected or it could be declared invalid. You can correct the inventors. This can be done by the United States Patent and Trademark Office (USPTO) or by court order.
Change of Owner (Assignment) and Change of Owner Name The original owner should record the assignment or name change with the USPTOs Assignment Recordation Branch by filing a Recordation Cover Sheet along with a copy of the actual assignment or proof of name change.
