A lasting power of attorney ( LPA ) is a legal document that lets you (the donor) appoint one or more people (known as attorneys) to help you make decisions or to make decisions on your behalf.
A Lasting Power of Attorney (LPA) is a legal document, therefore it can only be revoked or overridden by the donor through the OPG if they have mental capacity or through the Court of Protection if it needs to intervene.
To cancel an EPA before you lose mental capacity, make a deed of revocation stating that youre cancelling it and keep it with the EPA form. You and a witness must both sign the deed of revocation. Do not send the unregistered EPA and deed of revocation to the Office of the Public Guardian - you need to keep them.
You can object to the registration of a lasting power of attorney ( LPA ). You must tell the Office of the Public Guardian ( OPG ). You may also have to tell the Court of Protection. How you object depends on who you are and why youre objecting.
The death, incapacity or bankruptcy of the donor or sole attorney will automatically revoke the validity of any general power of attorney (GPA). GPAs can be revoked by the donor at any time with a deed of revocation. The attorney must also be notified of the revocation or the deed of revocation wont be effective.
If a donor wishes to remove one or more of their nominated Attorneys, they can prepare a partial deed of revocation and send it to the Office of the Public Guardian, together with the original Lasting Power of Attorney document.
If you have made and signed a Power of Attorney such as a Lasting Power of Attorney or an Ordinary Power of Attorney, you are perfectly within your rights to cancel it. It is also possible to make a Deed of Partial Revocation, which would allow you to remove an attorney without revoking the whole document.
Removing an attorney You can ask the Office of the Public Guardian ( OPG ) to remove an attorney if your lasting power of attorney ( LPA ) is registered and you still have mental capacity to make decisions. You will need to send OPG a written statement called a partial deed of revocation.
