hey everybody this is attorney Kenneth Stevens from the law firm Stevens PLLC and today what Id like to talk to you all about are easy ways to get rid of a lien thats been filed on a project now I know a lot of times that a lien gets filed and everybody starts to panic right I mean the owners losing it or the developers losing it because now theres a cloud on the title of the property your general contractor you got to deal with this headache because you know some subcontractors fought a lien or a material supplier what-have-you but I think a lot of times of liens kind of get blown out of proportion not saying that its a good thing for one to be filed but what I am saying is that sometimes theyre relatively easy to deal with so Im gonna talk about three ways to remove a lien relatively quickly and relatively easy the first way obviously is kind of a no-brainer is just to kind of try to work it out with the party that fought the lien most liens actually get worked out this way you

Generally, this requires the assistance of a lawyer. The homeowner may petition the courts under Civil Code Section 8480 in California to remove the mechanics lien when it is not timely issued or recorded. Under Section 53.171(c) of the Texas Property Code, a mechanics lien can be discharged with a bond even after the dispute has arisen and the lien has been filed. The bond must be substantially higher than the lien amounts.
When a lien has expired, it should either be automatically dissolved, or an owner should be able to remove the lien without an extensive, drawn-out process. Something as simple as a mere filing by the property owner (with notice to the lienor) should be possible to discharge a lien.
Mechanics liens are valid for 2 years after filing in Illinois. This means that, unless you extend the lien, you have 2 years to enforce your lien.
Court Petition to Release the Property Lien If the lien claimant doesnt remove the invalid lien, and the time has expired to record the mechanics lien and take action to foreclose, you may petition the court for a decree to release the property from the lien.

Here are a few ways to remove the lien: Invalidate the lien. If the lien is invalid or was obtained in a manner that doesnt follow the procedural requirements under the law, an attorney may be able to strip the lien from the property. Satisfy the debt. Negotiate a lower payoff. File for bankruptcy.
A judgment is not a lien on real estate for longer than 7 years from the time it is entered or revived, unless the judgment is revived within 7 years after its entry or last revival and a new memorandum of judgment is recorded prior to the judgment and its recorded memorandum of judgment becoming dormant.
How long does a judgment lien last in Illinois? A judgment lien in Illinois will remain attached to the debtors property (even if the property changes hands) for seven years.
