A lease agreement is a legally binding contract outlining the terms under which one party agrees to rent property, whether real or personal, from another party. This agreement includes important details such as the rent amount, duration, responsibilities of both parties, and conditions for terminating the agreement.
In Ohio, the buyer of a rental property has to honor the written lease between the previous owner/landlord and the tenant. Even if no lease exists (e.g., verbal lease), Ohio law presumes the tenant is on a month to month tenancy. In that case, the new owner must give proper notice to end that month to month tenancy.
Tenants in Ohio should provide written notice if they want to end the agreement before the lease term expires. Currently, there are two established notice periods: Weekly Leases - Seven days of notice. Monthly Leases - 30 days of notice.
The landlord tenant laws that allow you to break a lease are different from state to state. In many places, you can get out of your lease without penalty for a number of reasons, such as domestic violence, an unsafe environment, or if youve been called up for military service.
Commercial tenants may have the protection of the Landlord and Tenant Act 1954. The Act grants Security of Tenure to tenants who occupy premises for business purposes. The tenancy will continue after the contractual termination date until it is ended in one of the ways specified by the Act.
If you have a month-to-month lease, your landlord usually has to give you notice at least 30 days before the date they want the lease to end. For example, if your landlord wants your lease to end on Oct. 31, they must give you notice by Oct. 1.
Landlords can include an Early Termination Clause that explains all the consequences and terms to break a lease early. As mentioned before, most landlords only charge a penalty fee to cover the remaining rent. Others decide to charge their tenant for all the money they owe, and others decide to file a lawsuit.
So you may not have to pay much, if any additional rent, if you break your lease. You need pay only the amount of rent the landlord loses because you moved out early. This is because Ohio requires landlords to take reasonable steps to keep their losses to a minimumor to mitigate damages in legal terms.
