Can I move a tenant in with an unsatisfactory EICR? If your property is vacant, you must repair any faults identified before you move tenants in. This is because the faults identified with an unsatisfactory electrical certificate may endanger the tenants if not fixed.
The reports will need to be provided to your Tenants on move in or within 28 days of completion for existing tenancies, and a copy must also be given to the local authority within 7 days if requested.
You should make sure you clean the property and leave it in the same condition as when you moved in, apart from fair wear and tear. You need to do this so you get your deposit back at the end of your tenancy.
You are required to give copies of EICR to the following people: Existing tenants of the residential premises. Copies must be given to them within 28 days after testing and inspection. New tenants before they occupy the premises.
Since 1st April 2021 all tenancies in England have required a valid EICR. Landlords must supply a copy of a valid EICR to all tenants at the beginning of the tenancy, when issuing a new contract (including renewals), and also to any prospective tenant, if asked, within 28 days of receiving a written request.
To comply with the law, you will need to have the property surveyed with an EICR. As a landlord, this EICR will need to be carried out before it is let out to tenants, as this will not be their responsibility.
