Retainers are payment agreements between a client and a service provider. The client pays a specific amount of money to a business usually monthly and, in return, receives a set of services during that same time period.
Any unearned retainer fees that are not used can be returned to the client. Earned retainer fees, on the other hand, refer to the portion of the retainer that the lawyer is entitled to after work begins. Earned retainer fees may be granted to the lawyer bit by bit, depending on the number of hours worked.
A retainer fee is a payment made in advance by a client to an accountant or accounting firm for services to be provided in the future. You pay an accountant a retainer fee to get their services for a certain amount of time and to make sure they have a steady income.
A retainer agreement is a contract between a client and a professional who requires an upfront payment applied to future work. A retainer can be set up as a one-time payment or for a recurring period. The agreement will detail compensation, hours, contingencies, and any other terms for the services provided.
How to Sell Your Clients on a Monthly Retainer Get your foot in the door first. Sell value, not hourly. Keep your contracts clear and tight. Prove why youre worth it. Report on progress.
The client has the right to terminate the retainer at any time - the lawyer does not. Pursuant to rule 2.09 Withdrawal from Representation, Rules of Professional Conduct, you cannot withdraw your services except for good cause and upon appropriate notice to the client.
Think of a retainer contract as a work-for-hire agreement where you complete either a set amount of work for the client on a monthly basis or commit a set number of hours to their work. In exchange for your rolling services, the client pays you a fixed amount of money for an agreed number of hours each month.
About retainer fees If the fee agreement is a nonrefundable retainer agreement, you may not be able to get your money back, even if the lawyer does not handle your case or complete the work. A retainer fee also can mean that the lawyer is on call to handle the clients legal problems over a period of time.
