In Florida, state law does not require the parties involved in a real estate transaction to record a deed to make it valid. As provided by state law, a deed is deemed valid once it is executed, docHubd, and delivered.
Good to know: Beware that a Gift Deed cannot be revoked. Once the property is given away, you cannot get it back unless the person who received it transfers it back.
Adding someone to the title of your property in order to obtain or qualify for a loan may cause a reassessment of the property under Proposition 13 unless certain conditions are met.
In most cases, spousal removal from your deed will not be necessary. This applies when you already hold a type of house deed that enables the automatic transfer of property upon the death of a spouse.
Acknowledgments In addition to the signature of the grantor(s), deeds must be acknowledged to be recorded and acceptable as evidence of ownership without other proof.
Rather, recorded documents are made public to be used to help resolve disputes between parties with competing claims to a property. For instance, if two different claimants have conflicting deeds to a property, the date of recording can be used to determine the ownership timeline.
Deeds are public information and can be obtained in the Recorders office. Copies are $1.00 per page with most deeds being 1-2 pages long.
Registration of residential properties in England and Wales has been compulsory since 1990, so all title deeds from that date forth will be held by HM Land Registry.
