hey everybody this is attorney Kenneth Stevens from the law firm Stevens PLLC and today what Id like to talk to you all about are easy ways to get rid of a lien thats been filed on a project now I know a lot of times that a lien gets filed and everybody starts to panic right I mean the owners losing it or the developers losing it because now theres a cloud on the title of the property your general contractor you got to deal with this headache because you know some subcontractors fought a lien or a material supplier what-have-you but I think a lot of times of liens kind of get blown out of proportion not saying that its a good thing for one to be filed but what I am saying is that sometimes theyre relatively easy to deal with so Im gonna talk about three ways to remove a lien relatively quickly and relatively easy the first way obviously is kind of a no-brainer is just to kind of try to work it out with the party that fought the lien most liens actually get worked out this way you

The process of bonding off a mechanics lien starts after a claimant has filed a mechanics lien. After the claim is made, a general contractor or a property owner can contact a surety bond company to purchase a surety bond that replaces the value of the lien that was filed against the property.

The purpose of Indianas mechanics lien statute is to provide a contractor a remedy for unpaid labor or materials furnished to the improvement of real property. Information on specific requirements for filing a mechanics lien and release can be found in Indiana Code 32-28-3 and 32-28-6 .
Idahos lien law can be found in Idaho Code Title 45, Chapter 5. Under this law, when you hire a contractor to do construction work for you, that contractor has a right to secure payment for labor and materials by placing a lien on the property being improved.
Generally, this requires the assistance of a lawyer. The homeowner may petition the courts under Civil Code Section 8480 in California to remove the mechanics lien when it is not timely issued or recorded. A lawsuit is usually necessary to file it against the owner by the contractor or subcontractor.
New York Lien Law 20 provides that an owner may discharge a mechanics lien by the payment of money into court. Before a lien foreclosure action is commenced, the discharge is effectuated by depositing with the county clerk a payment equal to the amount claimed in the lien, with interest to the time of the deposit.
Court Petition to Release the Property Lien If the lien claimant doesnt remove the invalid lien, and the time has expired to record the mechanics lien and take action to foreclose, you may petition the court for a decree to release the property from the lien.
