Just Cause Eviction is a recent restriction passed into law by the California State Legislature that limits a landlords ability to terminate a lease for a tenant once that tenant has occupied the property for longer than 12 months throughout California.
Ask for more time to move. If you lose your eviction case, you need to move out (at the latest) 5 days after the sheriff posts a Notice to Vacate on your door. If you need more time to move, you can ask the court for a stay of execution. You will need to show the court that you have a good reason for needing more time.
A landlord uses a 30-day Notice to Quit (move out) to end a month-to-month tenancy if the tenant has been renting for less than 1 year. A landlord uses a 60-day Notice to Quit if their tenant has been renting for 1 year or more. In many cases, landlords cant cancel a month-to-month tenancy for just any reason.
As long as they provide adequate Notice, California Landlords may terminate a tenancy because of just cause when there is no fault or Lease violation by the Tenant. In this situation, just cause includes: Substantial renovations; The owner moving into the rental unit to make it their primary residence; or.
In California, landlords must file a 60 or 30-day notice to vacate letter before moving forward with an eviction. The notice of termination gives their tenant time to move out or deal with a dispute. If the tenant doesnt vacate the property after this time, landlords may start the eviction process.
How to ask for your eviction case to be dismissed Fill out forms. Fill out the following forms. Make copies of the form(s) Make 2 copies of the completed form(s). File the Request for Dismissal with the court. Serve the forms. File the Notice of Entry of Dismissal and Proof of Service.
If you get a 30 or 60-day Notices to Quit, it must be in writing and include: The tenant(s) full name(s) The rental homes address. That the month-to-month tenancy will end in 30 days if theyre giving a 30-day Notice or in 60 days if theyre giving a 60-day Notice.
Under Just Cause, landlords may only evict tenants for enumerated reasons, such as nonpayment of rent or a tenants bdocHub of their rental contract. After a landlord serves and files a lawful Notice of Termination, the tenant is required to vacate their home by the date stipulated on that notice.
