hello my name is mark um i wanted to drop a video regarding mechanics liens um i know that when when i have my situation here my property i live here in california southern california um i had a uh i hired a contractor to um you know some some shutters in my home wooden shutters uh when they installed them i wasnt really happy with the quality so i paid this person um half on delivery prior i we signed a contract i went ahead and i paid them half the value and then secondly uh once they delivered the product i was supposed to pay him the second half but when they delivered the shutters i noticed a lot of defects and when i relayed that information to the contractor he started using scare tactics that he wanted his money that that was not his problem that the manufacturer that i had to deal with them blah blah blah that he was going to put a lien on my property that if i wasnt going to pay him he was going to win in court um so i i stood in my ground i said im not gonna pay you unti

Step by Step Instructions Ask the claimant to release the lien. Obtain a certified copy of the lien. Copy and assemble the documents. File your documents, pay filing fee, and ask clerk for hearing date. Have the Petition and other documents served.
An owner may also bond the lien or deposit funds into Court to have it removed. The owner also has a right to demand and obtain a sworn statement called an itemization of lien from the company that filed the lien, which requires a full description of the work and materials which allegedly make up the lien.
The lien will expire and be removed within one year unless the contractor obtains an extension from court or pursues enforcement of the lien by a foreclosure action.
The Mechanics Lien must be served no longer than 120 days after the last provision of labor or materials and enforced within 180 days of this date.
The mechanics lien remains valid for one year provided the affidavit of service of lien is properly completed and filed. The one year time period is measured from filing in the County Clerks Office.
A mechanics lien will expire one year after the notice of lien is filed. Except for single-family dwellings, a lien may be extended for one additional year by filing a written notice of extension with the county clerk.
An original judgment lien is valid for 10 years. If the judgment isnt paid by the end of the first 10 years, then the judgment creditor can seek a renewal judgment on the lien that would be valid for another 10 years.
New York Lien Law 20 provides that an owner may discharge a mechanics lien by the payment of money into court. Before a lien foreclosure action is commenced, the discharge is effectuated by depositing with the county clerk a payment equal to the amount claimed in the lien, with interest to the time of the deposit.
