Section 14(2) of the CPA provides that a tenant must give 20 business days written notice to the landlord of their intention to terminate the lease agreement. The tenant remains liable for any amounts owed to the landlord in terms of the lease agreement up to the date of cancellation.
Heres a list of common fields that should be covered in your lease agreement: Basic information about all tenants. Include the full name and contact information of each tenant. Description of rental property. Security deposit. Monthly rent amount. Utilities. Lease term. Policies. Late fees.
Both the landlord and tenant must give at least one months notice to the other party when wanting to cancel the lease. (See Rental Housing Act 1999.) The Consumer Protection Act (CPA) gives additional rights to the tenant by allowing them to cancel the lease provided 20 business days notice is given.
A month-to-month tenancy may be terminated by either the landlord or the tenant simply by giving written notice from one side to the other. Unless the rental agreement or lease provides for a different time period, the notice to terminate must be given to the landlord at least 30 days before the tenant moves out.
Serve notice: The party wishing to terminate (either the landlord or tenant) should serve a notice to the other party as per the terms mentioned in the agreement. The notice period is usually one month, but it can vary based on the agreement.
Your rights as a tenant include: not having the landlord enter the property without prior notice and approval, the right to dispute the lease agreement, and. the right to give notice and terminate the lease before it expires (which might lead to penalty costs).
If a residential lease agreement was concluded because of direct marketing, then the tenant has the right to cancel the agreement within five days of signing the lease agreement. Unfortunately, if a tenant applied to rent a property of their own , the cooling-off period will not apply.
