No law in the US requires that parent and child have the same last name. It is usual that a childs name match that of at least one parent, but not required. A parent can change his or her name, without changing the names of any existing children.
Do both parents have to agree to the name change? A court is almost always more likely to grant a name change if both parents agree, but it is not necessary. As long as notice is given to the other parent, and the other parent has a chance to state their objections, then a name change can be made without consent.
Who Has the Right to Name a Child? Both parents have the right to name their children. If either you or the other parent want to change your childs name, you both have to agree to the change. If the other parent refuses to give consent, then you need to get approval from the court.
In California, you can ask the court to legally change your childs name. If you are the only parent making the request, you have to file a petition with the court, let the other parent know about it, and go to a court hearing. If your childs other parent does not agree, they have the right to oppose your request.
