An eviction is the court-ordered removal of a tenant from the property where they reside. A landlord may decide to evict a tenant for nonpayment of rent, damages, illegal activity, violating the terms of a lease, or if the landlord wishes to take possession of the property.
To do this, go to the court that ordered the eviction, find the court clerk, and request to file a notice of appeal. Make sure you have a copy of the eviction order with you. After filing the notice of appeal, file an emergency motion to stay the eviction pending the appeal.
Naturally, landlords are hesitant to rent to someone with an eviction on their record. Evictions can stay on your credit report for up to seven years, creating a great deal of trouble for someone who cannot afford to buy a home but still needs to secure housing.
Once the rent is paid, you can get the eviction off of your credit report by filing a release and satisfaction of judgment. If you were evicted because your landlord went through foreclosure, your eviction case must be sealed.
Having an eviction expunged is the best way to get an eviction off your record. When an eviction is expunged, it means future landlords cannot see the eviction on your rental history, and a rental applicant can select no when answering whether or not theyve ever been evicted.
If the case hasnt gone to court yet, then you can go to the court hearing and fight the eviction. If you are successful in fighting the eviction, then in that same hearing, you can ask the judge or court commissioner to make it part of the court record that this case is sealed or expunged from CCAP.
After the Writ of Execution has been served to the tenants, they will be given a grace period of 5 days to vacate the property. The sheriff will execute the eviction and forcibly remove them if they remain in the property after the grace period given to them.
Once the rent is paid, you can get the eviction off of your credit report by filing a release and satisfaction of judgment. If you were evicted because your landlord went through foreclosure, your eviction case must be sealed.
