The Office has a form PTO//40 to request correction in a patent application (other than a reissue application) relating to inventorship, an inventor name, or order of names. The form is reproduced below and is also available on .uspto.gov.
Inventorship of a patent is central to the United States patent system. It identifies who conceived the invention and, if incorrect, jeopardizes the validity of the patent.
Amendments to Names You can alter the names of the patent owners by sending a Recordation Cover Sheet to the Assignment Recordation Branch of the U.S. Patent and Trademark Office (USPTO). The process is the same regardless of whether the patent is under examination or already has been granted.
Where the inventors listed on a patent are incorrect, the patent will need to be corrected in order to properly make it enforceable. Correction of a named inventor can be done through either the USPTO or by filing a lawsuit in court requesting correction of the patent under 35 U.S.C. 256(b).
A petition to correct inventorship as provided by 37 CFR 1.324 requires (1) a statement from each person who is being added as an inventor that the inventorship error occurred without any deceptive intention on their part, (2) a statement from the current named inventors (including any inventor being deleted) who
