If builders contractors and suppliers have not been paid, they can file a mechanics lien on a property to ensure they get paid for their services and materials. When a mechanics lien is filed on a property, the property owner cannot do anything with the land or building. To resume action and discharge the lien, a property owner can get a Discharge of Mechanics Lien Bond. A Discharge of Mechanics Lien Bond allows property owners to do with their property as they would wish as if the lien were not present. The bond guarantees that the property owner will pay the contractor all monies owed upon final determination by the court. If the property owner does not pay the contractor, the contractor is protected by the bond and compensated. In this way, a Discharge of Mechanics Lien Bond does not entirely extinguish the lien; it just removes the lien from the property and places it on the bond. A lien is enforced by filing a lawsuit to foreclose the lien. Most often, this lawsuit will need to be filed in a county or circuit court based on the propertys location. In some scenarios, your suit can be filed using Florida Small Claims Rules.
A copy of the Claim of Lien must be served on the owner within fifteen (15) days from the date it is recorded. Thereafter, a lienor must file a lawsuit to foreclose the Claim of Lien within one (1) year from the date it is recorded unless a Notice of Contest of Lien is served on the lienor by the owner.
A California mechanics lien is only valid for 90 days. Unless it is extended, you will need to enforce your lien claim within this deadline.
Mechanics liens are valid for 2 years after filing in Illinois. This means that, unless you extend the lien, you have 2 years to enforce your lien.
A lien is valid for one year, unless a lienor files a lawsuit to enforce the lien prior to the expiration of the year. An owner has a right to file a Notice of Contest of Lien during the one-year period.
If you want to remove a lien from your property, you need to do one of two things: 1) have the contractor record a release of the lien or 2) file an appeal to have the lien released.
Liens are valid for five years from the original filing date. Florida law allows judgment liens to be filed a second time to extend the liens validity five more years. (See s. 55.201-55.209, F.S.)
Generally, this requires the assistance of a lawyer. The homeowner may petition the courts under Civil Code Section 8480 in California to remove the mechanics lien when it is not timely issued or recorded. A lawsuit is usually necessary to file it against the owner by the contractor or subcontractor.
