Discharging a Lien Claim A claimant must file a certificate to discharge (or cancel) the construction lien with the recording office in the county where the original lien claim was recorded when the claim is: Paid, satisfied, or settled between the parties. Forfeited by the claimant (see Drafting Note, Forfeiture).
New York Lien Law 20 provides that an owner may discharge a mechanics lien by the payment of money into court. Before a lien foreclosure action is commenced, the discharge is effectuated by depositing with the county clerk a payment equal to the amount claimed in the lien, with interest to the time of the deposit.
In New Jersey, once a mechanics lien is satisfied, the lien claimant must file a certificate discharging the lien with the county clerk within 30 days.
Consent Order/Court Order In exchange for the monies being held in court, the lien will then be removed. A Consent Order involves all parties (including the lienholder) agreeing to the monies being placed in Court in exchange for the removal of the lien. This is an amicable way to have the lien removed.
The options available to the property owner include 1) negotiating with the contractor to settle any dispute and paying the amount the parties may agree to, 2) initiating a suit against the contractor in court, or 3) wait and see if the contractor initiates a legal proceeding to enforce the lien.
In New Jersey, once a mechanics lien is satisfied, the lien claimant must file a certificate discharging the lien with the county clerk within 30 days.
Deposit the Lien Amount with the Court: A lien can be removed from the property if you file a lawsuit and deposit the lien amount into the courts registry. This allows the parties to litigate the validity of the claim, without the lien encumbering the property.
How long does a judgment lien last in New Jersey? A judgment lien in New Jersey will remain attached to the debtors property (even if the property changes hands) for 20 years.
