Correcting the Inventors This can be done by the United States Patent and Trademark Office (USPTO) or by court order. The USPTO requires a petition stating that it was an error and all the parties and assignees must make the application, agreeing it should be corrected.
The original owner should record the assignment or name change with the USPTOs Assignment Recordation Branch by filing a Recordation Cover Sheet along with a copy of the actual assignment or proof of name change.
More information about certificates of correction can be found in MPEP chapter 1481. A reissue is used for making more substantive changes or corrections than a certificate of correction is used for. It is an option that is only available to patent owners, and it requires a fee.
Signatures 37 CFR 1.4(d) contd A signature must be personally inserted/applied by the individual identified as the signer, regardless of the manner of making the signature. Handwritten (personally signed) signatures are provided for in 1.4(d)(1).
In requesting the Office to effectuate a court order correcting inventorship in a patent pursuant to 35 U.S.C. 256, a copy of the court order and a certificate of correction under 37 CFR 1.323 must be submitted to the Certificates of Correction Branch. In addition, form PTO/SB/44 should be filed.
