A correction deed, also known as a confirmatory or corrective deed, is a legal document used to fix errors on a property title that is recorded. Property owners can use this special type of deed to amend common errors such as misspellings, incomplete names, and other missing information.
A general warranty deed conveys both present and after-acquired interest of the grantor. The operative language in a general warranty deed is usually the expanded version, grants, bargains, sells and conveys; however only the phrase sells and conveys is required by statute.
California mainly uses two types of deeds: the grant deed and the quitclaim deed. Most other deeds you will see, such as the common interspousal transfer deed, are versions of grant or quitclaim deeds customized for specific circumstances.
A quitclaim deed contains no warranty of title and in no way obligates the grantor to defend the title to the land. Therefore, a person conveying property by a quitclaim deed may be conveying nothing or everything.
Grant deeds also convey after-acquired title to the California real estate. If the prior owner does not have good title to the property but later acquires title, the title that the transferor later obtains will automatically pass to the transferee. There is no need for a new conveyance.
Steps to fixing an incorrect deed Determine if the error is harmless or fatal to the transfer of title. Decide what instrument is best suited to the error. Draft a corrective deed, affidavit, or new deed. Obtain the original signature(s) of the Grantor(s). Re-execute the deed with proper notarization and witnessing.
Quitclaim deeds do not contain any implied warranties or covenants. Under a quitclaim deed, the grantor simply transfers its whole interest in the described real estate, but makes no covenant or representation that the grantor in fact has any interest in the subject property.
Quitclaim Deed This type of deed guarantees nothing and there is no expressed or implied warranty that grantor owns the property or any interest in it. Moreover, a quitclaim deed does not convey any after-acquired title.
