im drew stevenson and this is a lecture for my professional responsibility class about aba model rule 8.3 reporting professional misconduct our bottom line for this rule is that you can have an affirmative duty as an attorney to report ethical violations serious ethical violations of other attorneys in other words the failure to report could subject you to discipline in some cases the exceptions here matter as you might expect but thats our basic rule is that there are situations where if you overlook um a very serious ethical evaluation by someone else in your firm or even by opposing counsel and dont report it you could be in violation of model rule 8.3 so lets go to the rule and look at its actual text a lawyer who knows that another lawyer has committed a violation of the rules of professional conduct that raises a substantial question as to that lawyers honesty trustworthiness or fitness as a lawyer in other respects shall inform the appropriate professional authority now not

You should work with a lawyer to prepare a standard model release, but some basics include your name and contact information, the name of the model and their contact information, and the date and location of the shoot. I also recommend including a picture of the model with the release.
The purpose of a model release is to protect i.e., release you from liability in future lawsuits that your subject/model might file against you for legal claims like invasion of privacy, defamation of character, etc. The document stipulates the terms under which one party may use photos taken of another party.
An employee model release form gives the employer the right to use an employees likeness and image in the designated and agreed upon terms.
How Do You Write a Release Form? The first step in writing is identifying all parties involved, including the releaser and the release. Specify the activity or event in detail, such as a photo shoot, a video production, or a performance. Clearly specify what is being released, whether liability, claims, or damages.
A Model Release Form is like a contract. It specifies all the ways the resulting images can or cannot be used. If you are the photographer, you will want to use the broadest language possible about where and in which media formats the image can be used, so you will have great latitude in selling the photo.
In an ideal case, a photography model release form should be short and sweet. It needs to contain the photographed persons name, address, phone number, and a witness. However, there are much longer versions used for more important, commissioned work.
What is a model release form? A model release form is a liability waiver signed by a model, actor, or other performer that grants a production entity the right to commercially publish their name, voice, image, likeness and/or performance within specific, agreed-upon terms. In other words, its a legal contract.
