A Revocation of Power of Attorney must plainly state your desire to revoke a previous POA and include: The principals name. The attorney-in-facts name. The date the Power of Attorney took effect. The date the Power of Attorney is revoked. A notary public seal of certification (only required in certain states)
To revoke or cancel a Power of Attorney, you must inform in writing: your attorney that you are bringing their appointment to an end. your bank and any other relevant groups or businesses that attorney may have been dealing with.
A power of attorney that is unlimited as to time applies until you die or revoke it. If you want your power of attorney to still be valid even if you lose your mental capacity after you make it, you must make an enduring power of attorney.
If you are concerned that the attorney is not acting in the best interests of a person who has lost capacity, you can apply to NCAT for a review. To apply for the review of an Enduring Power of Attorney: Application to review an enduring power of attorney (PDF , 536.4 KB)
Changed circumstances, unforeseen at the time the power of attorney was created, may warrant revocation or override. For example, if the attorney-in-fact named in the document is no longer willing or able to serve, or if there are irreconcilable differences between the principal and the attorney-in-fact.
You may opt to simply advise your Power of Attorney that you are cancelling their powers, however it is best to do so in writing so it can be clearly and easily proven at a later date if required. Further, you must ensure that the Attorney whose powers you are cancelling gets a copy of this revocation.
As long as you are mentally capable of making a Continuing Power of Attorney for Property, you can take it back (cancel or revoke it). To do so, state in writing that you revoke it. Two people must witness you signing this statement. Both people must be with you when you sign.
