What Happens if One Person Doesnt Want to Pay the Existing Mortgage? Even if one person doesnt want to or cant pay the mortgage, both people are likely still on the hook for the debt. The lender can often come after either person for the full amount of the existing mortgage, no matter who is named on the mortgage.
Many couples, especially those with two incomes, often have no choice but to sell their homes, pay off their loans and split the remaining money. Others opt to let one partner keep the property, often through a deed transfer and a reassignment or refinancing of the mortgage.
If you obtained a joint mortgage with your ex, both of you are responsible for the debt. Divorcing couples with a joint mortgage typically opt to sell the marital home, refinance the mortgage to a new loan in one spouses name or have one party buy out the other.
Filing a Quitclaim Deed Once youve been informed that your refinance has been approved, you should have your spouses name taken off of the deed to the property as well as the mortgage. Typically, you do this by filing a quitclaim deed, in which your spouse gives up any right to the property.
Most divorce professionals request a Quit Claim Deed when transferring property for a divorce sale. A basic understanding of the various real estate deeds, i.e., Quitclaim deed vs. Warranty deed, is a must when transferring title and ownership to real estate during a divorce.
Does It Matter Whose Name Is on the Mortgage in a Divorce? While the name on the mortgage can influence who is responsible for the debt, it doesnt necessarily dictate how the property is divided.
Divorce. If a vehicle is awarded as a result of a divorce decree, give a certified copy of the decree to your county tax office and apply for title. If the decree does not award the vehicle, a properly assigned title (where your ex-spouse signed the title over to you) will be required.
What Happens If Your Spouse Is Not On the Mortgage. If your spouse is not on the mortgage, they are not responsible for paying it. However, the mortgage lender can foreclose on the house if the mortgage is not paid.
