Can my landlord take pictures of my apartment and its contents? Yes, however the landlord must identify the purpose behind taking the pictures either before or at the time of taking the pictures. This is because taking pictures of your rental unit is a collection of your personal information.
A: In California, landlords generally have the right to conduct annual inspections of rental apartments, but they must provide advance notice to tenants.
A landlord may have the right to enter his property, even against his tenants wishes, as long as he has given proper written notice and the entry occurs during normal business hours. California requires a landlord provide reasonable advance notice of intent to enter and considers 24 hours reasonable absent
This checklist is a practical and highly systematic means of monitoring the overall condition of the property. It provides a means of documenting the state of the property at various times, such as, prior to a tenant moving in, while the tenant is residing at the property, and after the tenant moves out.
A landlord must give the tenant at least 48 hours written notice of the inspection for a time that is mutually convenient for all parties. If agreed, the landlord and tenant can waive the 48-hour requirement. The tenant can request to be present during the inspection.
Under California law, landlords are not permitted to enter rental premises solely for the purpose of conducting inspections, even if such inspections are mandated by the landlords liability insurance policy.
Unless the tenant later withdraws the request for an initial inspection the landlord and tenant must try to schedule the inspection for a mutually acceptable time, and the landlord must provide at least 48 hours written notice of the time and date agreed upon.
Inspection Guidelines Inspect the property when tenants move in or out, and once or twice a year. This ensures proper maintenance and prevents costly repairs. Tenants may not report or recognize issues, so regular checkups are important. Inspections also ensure compliance with rental agreements, like pet restrictions.
