Under Section 12.19 of the San Francisco Rent Ordinance, if a tenant is forced to vacate his or her unit due to fire, within 30 days of the completion of repairs to the unit, the landlord must re-offer the unit to that tenant under the same terms and conditions as existed prior to his/her displacement.
The landlord can only withhold his approval on reasonable grounds. Standards of reasonableness are outlined in Section 6.15 of the Rent Ordinance Rules and Regulations. Basically, the landlord can refuse the person on the grounds of either an eviction on his record or a bad credit rating.
A San Francisco landlord is required to give a tenant a minimum of thirty days written notice if their rent is increasing less than 10%. For any rent increase beyond 10%, whether its a banked increase for a rent controlled unit, or otherwise, requires a ninety-day written notice.
You usually do not have full rent control protection if you live in a single family home (a single family home with an illegal in-law unit counts as a 2-unit building) or a condominium and you (and your roommates) moved in on or after January 1, 1996.
