Provide your landlord with as much notice as possible and write a sincere letter explaining why you need to leave early. Ideally, you can offer your landlord a qualified replacement tenant with good credit and references to sign a new lease.
I am giving 1 months notice to end my tenancy, as required by law. I will be leaving the property on (date xx). I would like you to be at the property on the day I move out to check the premises and for me to return the keys. I also need you to return my tenancy deposit of (state amount).
Have a Talk with your Landlord. If you wish to leave early but dont want to pay the standard fee, you can try talking it out with your landlord. In this case, you need to be honest about your reason for leaving early (if the reason doesnt fall in the Florida Landlord-Tenant Law).
Generally, your initial apartment lease runs for one year. In California, ing to the Department of Consumer Affairs, after a year the agreement operates on a month-to-month basis, allowing the landlord or tenant to terminate the agreement by giving 30 days notice.
You can usually give notice at any time, unless you have a break clause or a tenancy agreement that says otherwise.
Giving notice After a fixed-term tenancy has ended, the tenant must usually give 3 months notice if they want to end the lease. The landlord must usually give 6 months notice. The lease will state the amount of notice each party must give.
You have these options: Speak to other joint tenants. Use a break clause. Negotiate with your landlord. Unwind a contract because of misleading information. Options if you cannot get out of your contract.
When you break a lease without a legally protected reason, the landlord may sue you for damages. However, the landlord must mitigate damages by attempting to re-rent the unit.
You can try and negotiate with your landlord to end the tenancy before it begins. Your landlord may consider agreeing to end the tenancy if you have a good reason.
The tenant will be liable for the full rent until a new tenant has been introduced and a replacement tenancy has started. These costs are as follows: 14.4% of the value of 6 months rent inclusive of VAT at the current rate (12% plus VAT).
