What Is a Pour-Over Will? A pour-over will is a legal document that ensures an individuals remaining assets will automatically transfer to a previously established trust upon their death.
In the legal world, if you die without a will, its called dying intestate. A local probate court then has to decide how to distribute your property. While they follow state intestacy laws that try to mimic the final wishes of the average person, your actual wishes remain unknown.
The main downside to pour-over wills is that (like all wills), the property that passes through them must go through probate. That means that any property headed toward a living trust may get hung up in probate before it can be distributed by the trust.
Assuming all beneficiaries agree to the final accounting, to the plan of distribution, and to sign the Receipt, Release, Refunding Agreement, the trust may be terminated without court authorization. Alternatively, it may be necessary to obtain a court order to approve the accountings and terminate the trust.
Do assets in a pour-over will avoid probate? Not necessarily. Assets in a pour-over will only avoid probate if their total value is under $184,500, thereby qualifying the estate for a small estate affidavit. If the assets total more than $184,500, then they will have to go through probate.
