- Well hey there, this is Seth and in this video Im going to take you through the process of how to put together a warranty deed and a quick claim deed. If you know anything about deeds, those two types of deeds are actually very very different from each other but in terms of the actual information that has to go into the document, its fairly similar across both of them. Creating a deed is actually a fairly simple thing just in terms of what information you have to put in there and how to put it all together so if thats something youre trying to do, I just want to show you the basics of how that is done and Im gonna be showing you on a couple of blank templates that Ive used in the past and I will say that these deed templates Im going to be showing you do not work in all 50 states so dont just take these and start using them whenever you want to. A lot of states have different laws and statutes and just details that need to be baked into deeds based on whatever state your prop

Essentially a quitclaim deed provides the same protections as a warranty deed, except it limits how far back in time the grantor is liable for any problems resulting from the title.
Removing a Name From a Property Title Talk about property ownership interests. Get a copy of the deed. Complete the transfer of title form. Turn in the form and payment. Ask for a certified copy of your quitclaim or warranty deed.
What Is a Quitclaim Deed in Massachusetts? A Massachusetts quitclaim deed also known as a quitclaim covenant is comparable to special warranty deeds in other state. Quitclaim deeds are a document used to legally transfer property and buildings from one party to another, such as a seller and buyer.
Once a deed is recorded it cannot be changed. We recommend you consult a real estate attorney or title company to prepare a new deed. If a married couple held the property jointly as tenants by entireties and one spouse dies, it is not necessary to remove that spouses name from the deed.
A Massachusetts general warranty deed is used to convey the title to real property from a seller to a buyer in Massachusetts. This deed is a sellers guarantee that the seller has the legal right and authority to sell the property and the title to the property.
If you wish to remove someone from a deed, you will need their consent. This can be done by recording a new deed, which will require their signature. If the person in question is deceased, you will need their death certificate and a docHubd affidavit along with the new deed.
Quitclaim deeds are the most common type of deed in Massachusetts. The primary difference between a quitclaim deed and a warranty deed is that while a warranty deed makes guarantees for the time before the grantors ownership, a quitclaim deed only makes guarantees for the time of the grantors ownership.
Under Massachusetts law, if a grantor conveys ownership with quitclaim covenants, it must convey title that is free from all encumbrances made by the grantor. It must also defend against any claims to title that arose during its ownership, subject to any exceptions it makes.
