To change a custody order, you will need to consult with a lawyer to ensure your rights are protected. You will be required to fill out paperwork and file it with the court and then wait for your hearing date.
In order to modify a custody agreement in Michigan, you need to file a motion and get a hearing in front of a judge. Even when both parents agree to the modification you are still required to file a motion and attend a court hearing.
How Do I Request Modification? Making a request only requires you to submit one form: Form FL-300, the Request For Order. Once filed with a court, the process will begin in earnest. You may also file Form FL-311, Child Custody, and Visitation, though this is optional.
Keeping a child away from the other parent can backfire in serious and permanent ways. If the other parent feels that the situation will not resolve itself, they have the legal right to bring the matter before the court to enforce the existing court order regarding the parenting plan and their visitation rights.
