Everything is considered community property until proven to be separate property during a Texas divorce, so even if it is your house from prior to marriage, you cannot kick someone out or change the locks.
If a common law couple decides to split up, they must file for divorce. See our Divorce guide for more on how to file. Please note: If court proceedings are not filed within two years of the separation, Texas law presumes a common law marriage never existed unless it is proven otherwise.
The process for getting a divorce for common law marriage in Texas is exactly the same as a formal officiated marriage. You will need to file a petition for divorce with the court and serve your spouse. That will get the process started.
For common law couplesi.e., couples who have lived together but never married there is no formal process that must be followed in order to separate, and no need for divorce. Common-law couples can dissolve their union at any time, with no required legal action.
Fact 5: Informal marriages dont have a required timeline but DO have an expiration date in Texas. There is no set period of time that a couple must be together in order to assert they are common law married in Texas.
If the couple is able to come to agreement, they can file a joint application for divorce. If they cannot agree, the application for divorce is submitted to be decided by a judge.
When two people who have been living together in a marriage, or a marriage-like relationship (sometimes called a common-law relationship), decide not to live together any more, they are separated. There is no such thing as a legal separation. If you are living apart, you are separated.
