One way is for a joint tenant to convey their interest to a third party, either by sale or gift. The act of conveyance severs the joint tenancy and converts the propertys ownership to a tenancy in common. Florida law does not require you to obtain the consent of the other joint tenants to sever the joint tenancy.
The main difference between the joint tenancy with right of survivorship and the joint tenancy, and even the tenancy in common is that your heirs or the beneficiaries under your last will and testament will not be able to inherit your property unless they are one of the other joint tenants.
Married couples purchasing real estate in Florida may hold title as tenants in common, joint tenants with rights of survivorship or as tenants by the entirety (TBE).
The most recognized form for a married couple is to own their home as Tenants by the Entirety. A tenancy by the entirety is ownership in real estate under the fictional assumption that a husband and wife are considered one person for legal purposes. This method of ownership conveys the property to them as one person.
Joint with rights of survivorship (WROS) accounts provide equal ownership rights to all owners. If one of the owners passes away, the remaining owners fully own the account. For example, assume John and Stacey own a joint WROS account together. If John passes away, Stacey now owns the entire account.
Under Florida law, when you add the words right of survivorship to a joint tenancy, that means full title to the real estate goes to the owner that survives the death of the other(s). The survivor of the joint owners automatically owns 100% of the asset when the other joint owner (or owners) passes away.
A survivorship requirement means that a beneficiary cannot inherit from you unless he or she lives for a certain period of time longer than you do. In general, its a good idea to include a survivorship clause in your will or trust.
Jointly owned Property with rights of survivorship (JTWROS) offers no protection from creditors. Creditors of any owner can file against any owner of the property. Ways Tenancy by the Entireties can be defeated. Anytime property is changed from TBE to Joint tenants it looses this protection.
JOINT TENANCY WITH THE RIGHT OF SURVIVORSHIP AS A WAY TO HOLD TITLE TO REAL PROPERTY IN FLORIDA. The main ways to hold title to real estate in Florida are (1) Tenants in Common (2) Tenants by the Entireties and Joint Tenants with the Right of Survivorship.
Holding property as tenancy by the entirety has three important benefits under Florida law: Avoiding Probate Property owned as tenancy by the entirety passes automatically to the surviving spouse upon the death of the first spouse to die. There is no need to deal with the property in probate.
