Generally, it is not possible to terminate an employment contract before the end date arrives, but there are certain situations where it is possible to do so depending on the clauses in the contract and what actions occur between employee and employer.
Legally, a date is not required; if there is an expected timeline but a listed date is not on the contract, it is not considered enforceable. If the contract is undated but is marked as for consideration, it is still valid. For consideration shows that each party has something to offer the other.
For example, one year. An employment contract for an indefinite period of time is entered into for an indefinite period of time. In other words: there is no end date attached to this contract. The employment contract for an indefinite period of time is therefore often referred to as a permanent contract.
​As its name implies an indefinite contract of service means that the employee is engaged in an employment for an indefinite period (without a limit). On the other hand a fixed term contract is a contract wherein both parties usually agree on its duration and thus incorporates an expiry date.
The temporary employment contract has a maximum duration of 180 days, which can be consecutive or not. In addition, it can be extended for another 90 days (also consecutive or not), as long as the employer proves that the extension of the contract is necessary.
Updated November 17, 2020: When there is no termination clause in an employee contract, it means an indefinite contract of employment is in place, but a termination is still an option with reasonable notice given. There is some question as to how much notice is considered reasonable.
A contract expires in two ways either the contract states a specific end date or fixed period that the parties have agreed on, or the obligations of both parties are performed so the contract ends automatically.
If the contract period has expired, the contract comes to an end automatically. In such a case there is no dismissal. Fixed-term contracts may terminate prior to a fixed date for a reason recognised in law e.g. misconduct or poor performance.
