How Do I Request Modification? Making a request only requires you to submit one form: Form FL-300, the Request For Order. Once filed with a court, the process will begin in earnest. You may also file Form FL-311, Child Custody, and Visitation, though this is optional.
If your judge is known at least 10 days before the hearing date, you must make your motion at least 5 days before that date. To avoid missing the deadline, file your motion as soon as your trial judge is assigned. If you are assigned a different judge for trial, make a motion as soon as the new judge is assigned.
Thus, the requesting party must show that a change is justified. Common substantial changes in circumstances may include: a loss or gain of employment, a sudden change in either partys finances, a relocation of the parties or children, a death, a change in the childs wishes, etc.
Child Custody Modification Agreement If you and the other parent agreed on a parenting plan, you may need to renegotiate different portions of the agreement every so often. If you and the other parent can agree on the changes, you do not need to go to court. You only need to write a new parenting agreement.
Common substantial changes in circumstances may include: a loss or gain of employment, a sudden change in either partys finances, a relocation of the parties or children, a death, a change in the childs wishes, etc.
Steps to Change a Custody Order Get the current custody (parental responsibilities) order. Fill out your custody modification forms. File your forms with your local countys court. Tell the other party about your petition and the upcoming court date through legal service. Go to your hearing.
Reasons a Judge Will Award a Child Custody Modification Child is in danger (physical, emotional, sexual, or psychological abuse) One or both parents situations have changed. The non-custodial parents work schedule changed. The non-custodial parent moved closer to the other parent.
To do this you may: (1) obtain the services of an attorney to handle your case; or (2) file the case yourself by using the Domestic Relations forms. Use this form only if there is already a court order for custody or visitation AND you were named as a plaintiff or defendant in that court case.
