And the reason why I make that joke is just to carry home the point that theres a lot of risk in terminating design and construction contracts and its not something that you want to do lightly and its not something that you want to do without a lot of thought ahead of time. Indefinite contracts are defined as contracts that have no specified end date. This means that the period of employment continues indefinitely until either the employer or employee terminates the contract.
The base date sets the reference date from which the conditions under which the tender was prepared are considered to have been known by the contractor and so are properly reflected in their price. If specified conditions change before the contract is implemented, then the contract may be adjusted to reflect this.
Completion date This is the date when you can move into your new home. The estate agent is likely to hold the keys for you to pick up. On completion day, your solicitor will arrange for money to be transferred to the sellers solicitor.
Legally, a date is not required; if there is an expected timeline but a listed date is not on the contract, it is not considered enforceable. If the contract is undated but is marked as for consideration, it is still valid.
Required Completion Dates means collectively, or individually, the completion dates established by the Agreement, including but not limited to the Project Substantial Completion Date, Contractor Substantial Completion Dates, the Final Completion Date, or the Scheduled Completion dates.
An employer cannot remove all the works from the contractors scope or omit such a large element of work so as to effectively terminate the contract.
If a contract does not specify a completion date, then the works should be completed within a reasonable time, although it is unlikely that such an ambiguous arrangement would allow the client to deduct liquidated and ascertained damages.
If the Contractor fails to complete the Works or a Section by the relevant Completion Date, the Architect/Contract administrator shall issue a certificate to that effect.
