Can I Inherit Debt in North Carolina? The short answer is no, you cannot inherit a loved ones debt in North Carolina. The only exception to this rule is if you are a co-signer on one of their loans (car payment, mortgage, etc.).
Time Limits for Notice to Creditors in Deceased Estates Creditor claims are filed with the Clerk of Court in the county where the deceased person lived. If the value of the estate is less than $300,000, creditors have 60 days to file a claim. If the estate is worth more than $300,000, creditors have 90 days.
North Carolina Summary: Under North Carolina statute, where as estate is valued at less than $20,000 ($30,000 if the affiant is a spouse and sole heir), an interested party may, thirty (30) days after the death of the decedent, issue a small estate affidavit to collect any debts owed to the decedent.
Notices to creditors must be published once a week for four (4) consecutive weeks and should state that claims must be filed by a date certain, which date is at least three (3) months from the date of first publication of the notice.
NC Specifics In North Carolina, creditors have at most 3 years from the date of death to file claims against the estate.
If the creditor has failed to send a periodic statement, the 60-day period runs from the time the statement should have been sent. Once the statement is provided, the consumer has another 60 days to assert any billing errors reflected on it.
For purposes of this section, the term billing error means: (1) A reflection on or with a periodic statement of an extension of credit that is not made to the consumer or to a person who has actual, implied, or apparent authority to use the consumers credit card or open-end credit plan.
