In the immigration context, a common-law partnership means that a couple have lived together for at least one year in a conjugal relationship [R1(1)]. A common-law relationship exists from the day on which two individuals can provide evidence to support their cohabitation in a conjugal relationship.
For common law couplesi.e., couples who have lived together but never married there is no formal process that must be followed in order to separate, and no need for divorce. Common-law couples can dissolve their union at any time, with no required legal action.
If the couple is able to come to agreement, they can file a joint application for divorce. If they cannot agree, the application for divorce is submitted to be decided by a judge.
Couples who have been living together for two years share the same legal rights as married couples in BC, including a 50/50 split of debts and assetsexcluding pre-relationship property, inheritances and gifts. A partner in a common law relationship can also be entitled to spousal support.
Generally, an unmarried individual has no right to property that is in his or her partners name. In the event of a break up, the property goes to the individual who retains legal ownership. For debt, the individuals listed on the paperwork remain responsible for payment.
If you are common-law, you must have lived together for a minimum period of time to qualify as a spouse. In order to be considered a spouse for the purposes of dividing property or debt you must have lived together in a marriage-like relationship for at least two years.
