These requirements may also impact the scheduling of annual leave. Annual Leave: Active duty Soldiers earn 2.5 days of annual (chargeable) leave for each month of service, for a total of 30 days per year. Currently, Soldiers can bank up to 60 days of leave at the end of the fiscal year.
While annual leave does need to be taken at a time that has been agreed to by the employer, once the period of leave has commenced an employer does not have a unilateral right to recall an employee from annual leave.
The employees timekeeper should use Transaction Code 68, on the employees time and attendance report to pay the employee for the 22 days of military leave. Holidays and non-duty weekends do not count against the 22 day emergency military leave ceilings.
Mandatory Approval of Leave Requests for Military Service An eligible employee must be granted, upon request, military leave to which he or she is entitled for performance of active duty or active duty for training.
Every command will have its own procedures for requesting leave. It may involve a paper or electronic leave request form sometimes called a leave chit. The command will then approve or deny the leave request.
Leave is an earned benefit not a privilege. Therefore the only person that can revoke your leave status and return you to duty is the commander granting the leave. Your leader can request your leave be cancelled.
However, the commander approves or denies all leave requests based on unit mission/training, pending Uniformed Code of Military Justice action, administration action, health and welfare of the Soldiers or unit strength percentages.
The decision to call an employee back in to work on a scheduled day off is entirely up to the employer. An employer can make the working on a scheduled day off or working a full shift as a condition of employment regardless of an employees start-time or end-time.
