Is it paid or unpaid? Employers with 11 or more employees must provide paid sick time. Employers with fewer than 11 employees must provide earned sick time, but it does not need to be paid.
Chapter 149 of the General Laws, 148C and 940 CMR 33.02 require that the employer shall provide a minimum of one hour of earned sick time for every thirty hours worked by an employee, up to a maximum of 40 hours of sick time in a calendar year.
Massachusetts laws 149, 148C and 148D Employees who work for employers having 11 or more employees may earn and use up to 40 hours of paid sick time per calendar year, while employees working for smaller employers may earn and use up to 40 hours of unpaid sick time per calendar year.
The minimum requirement is either one hour for every 30 hours worked, or 40 hours per year. This is only required to be paid if there are 11 or more employees that work for the business. Unused sick days do not have to be paid out at termination.
Abuse of Sick Leave is defined as the use of sick leave for purposes other than those set forth in the Sick Leave, Personal Leave and Bereavement Leave Policy, or the legitimate use of sick leave when it negatively impacts the Employees work performance or the operations of the Institution.
If you hand in your notice while on sick leave there is no obligation on you to return to work if you are not well enough to do so. Your normal contractual terms and conditions remain the same during the notice period.
Your employer will need to hold a disciplinary hearing before dismissing you. If you cannot attend the hearing because you are on sick leave (or call in sick on the day), the employer might decide to reschedule it for another day.
