How long does a commercial tenant eviction take? Since there are so many variables that influence how long the procedure takes, its impossible to give specific figures. However, some instances can take as little as six weeks from the date of the eviction order, while others can take up to six months.
Under Michigan law, before a court will issue an Order of Eviction, a landlord must serve the tenant with a proper notice. After serving notice, a landlord must wait either 7 or 30 days, depending on the reason for an eviction, before seeking relief from a court.
It takes about 14 to 90 days from the issuance of the Notice to Vacate, depending on the reason for eviction and the lease agreement.
On average, the eviction process can take 40 - 90 days after the tenancy or occupants right to possession of the property has been terminated.
You must give the tenant a minimum of three (3) days notice before eviction for non-payment of rent. Other contract violations require a minimum notice period of fifteen (15) days.
A periodic tenancy cannot be terminated by the landlord without giving notice to the tenant. The amount of notice that the landlord needs to give will be determined by reference to the regularity of the payment of the rent.
