When a joint tenant dies or becomes incapacitated, the ownership interest passes without probate to the remaining joint tenants. In a joint tenancy, an ownership interest cannot be willed to someone who is not a joint owner. Most joint tenancies with right of survivorship are between spouses and other family members.
Generally, and in the past, the most important factor in determining whether a joint account is with rights of survivorship is whether the bank signature card establishing the account identifies the interests of the parties as being with rights of survivorship.
Sometimes referred to by its full name or acronym, a joint tenancy creates rights of survivorship upon a tenants death. This means that when a joint tenant dies, their shares automatically transfer to the surviving co-tenant(s).
When joint owners hold an asset as joint tenants, on the death of one of the joint owners the asset passes to the surviving owner (or owners) automatically, irrespective of the deceased joint owners will. This is what is meant when assets are said to pass by survivorship.
Which of these cannot take title as a joint tenant with right of survivorship? A corporation. Because a corporation continues indefinitely until terminated by legal action, a corporation may never take title as a joint tenant. It would never die.
You need to apply to the court for a grant of probate. Once you have your grant of probate, you need to make an application to the Land Registry to change the register using form AP1. This needs to be accompanied by a sealed or certified copy of the grant of probate and a document called an assent (form AS1).
This is usually when the amount of money in the account is below a certain threshold (usually 15,000-25,000). However, in many cases the only way to legally access money belonging to an estate is to administer that estate and apply for a Grant of Probate. This process is referred to as probate.
