Is it paid or unpaid? Employers with 11 or more employees must provide paid sick time. Employers with fewer than 11 employees must provide earned sick time, but it does not need to be paid.

Be flexible about allowing workers to make up time theyve taken off for a legitimate reason for example, to care for a sick family member.
All employees of a covered employer are eligible for sick leave, including full-time, part-time, temporary, and seasonal employees. Sick leave begins to accrue on the employees first day of work. However, employees may not use sick leave until they have worked for the employer for 90 days.
The minimum requirement is either one hour for every 30 hours worked, or 40 hours per year. This is only required to be paid if there are 11 or more employees that work for the business. Unused sick days do not have to be paid out at termination.
The supervisor is responsible for approving or disapproving requests for sick leave by signing PS Form 3971, a copy of which is given to the employee.
It is used to address attendance problems or misconduct involving leave abuse, and to give employees notice that they may be violating Civil Service Rules governing appropriate sick leave use. While on Sick Leave Restriction, employees may only use sick leave with medical certification from a health care provider.
Chapter 149 of the General Laws, 148C and 940 CMR 33.02 require that the employer shall provide a minimum of one hour of earned sick time for every thirty hours worked by an employee, up to a maximum of 40 hours of sick time in a calendar year.
Massachusetts laws When an employee leaves their position, their accrued vacation time will be included in their final paycheck and will be paid to them at the time designated by this law depending on whether they resigned or were discharged. MGL c.
Massachusetts laws 149, 148C and 148D Employees who work for employers having 11 or more employees may earn and use up to 40 hours of paid sick time per calendar year, while employees working for smaller employers may earn and use up to 40 hours of unpaid sick time per calendar year.
