Once the rent is paid, you can get the eviction off of your credit report by filing a release and satisfaction of judgment. If you were evicted because your landlord went through foreclosure, your eviction case must be sealed.
The way to get your eviction removed from public record is to dispute something that is incorrect, win a case, or file a petition with the courts.
You can ask that the eviction file be sealed as part of an agreement with the landlord. Sometimes landlords and their lawyers will agree to seal an eviction court file as part of a larger agreement.
An eviction typically registers on reports within 30 days of a court judgment being entered against you to leave the dwelling, but it may take up to 60 days. The landlord doesnt have to report the judgment. Credit bureaus search for the information and update their databases from public records.
If the eviction case was only for nonpayment of rent, you may stop the eviction any time before you are actually evicted by paying the amount the Magisterial District Judge ordered, including court costs. This is called the right to pay and stay.
You can also enter an agreement with the landlord to seal your eviction record so no one will be able to see that you were evicted. Usually, this is part of a larger agreement for payment of past-due rent. Keep in mind that sealing is not the same thing as having the eviction removed (expunged).
Naturally, landlords are hesitant to rent to someone with an eviction on their record. Evictions can stay on your credit report for up to seven years, creating a great deal of trouble for someone who cannot afford to buy a home but still needs to secure housing.
The Appeals Process You can also appeal an eviction order if you disagree with it. You must file your appeal within 30 days of the eviction order. To do this, go to the court that ordered the eviction, find the court clerk, and request to file a notice of appeal.
